Public Liability Waiver for Evexia (Kos) Retreat Planning Services

PLEASE READ CAREFULLY BEFORE SIGNING. BY SIGNING THIS DOCUMENT, YOU ACKNOWLEDGE AND AGREE TO THE TERMS AND CONDITIONS BELOW.

 

1. Scope of Services

I understand that Evexia (Kos) Retreat Planning Services (“Evexia”) acts as a planning and coordination service for retreats, including but not limited to booking accommodations, arranging activities, securing transport, and facilitating wellness or fitness-related experiences (the “Services”).

I acknowledge that Evexia serves as an intermediary between me (the “Client”) and third-party service providers, including but not limited to hotels, instructors, transport companies, and activity organizers (the “Providers”). Evexia does not own, manage, or control these Providers.

 

2. Assumption of Risk

I understand and accept that:

  • Participation in any retreat activities, services, or experiences arranged by Evexia involves inherent risks, including but not limited to accidents, injuries, illness, property loss, or delays;

  • Evexia is not liable for the performance, actions, or omissions of third-party Providers, including any injuries, damages, or losses resulting from their services;

  • I am responsible for assessing my own fitness and suitability to participate in any activities or experiences included in the retreat.

 

3. Release of Liability

To the fullest extent permitted by law, I release, waive, and discharge Evexia, its owners, directors, staff, contractors, agents, and affiliates (the “Released Parties”) from any and all liability for:

  • Personal injury, illness, death, or property damage resulting from retreat activities, accommodations, or services arranged by Evexia;

  • Claims, demands, or actions arising from the negligence, omissions, or misconduct of third-party Providers or other participants in the retreat;

  • Any unforeseen events, delays, or cancellations caused by weather, travel disruptions, government regulations, or other circumstances beyond Evexia’s control.

 

4. Indemnification

I agree to indemnify and hold harmless the Released Parties from any claims, demands, costs, or expenses (including legal fees) arising out of:

  • My participation in activities or services arranged by Evexia;

  • My failure to follow instructions or abide by the terms and conditions of the Providers;

  • Any breach of this agreement by me.

 

5. Emergency Medical Treatment

In the event of a medical emergency, I authorize Evexia or its representatives to arrange for emergency medical treatment on my behalf. I agree to bear all costs associated with such treatment and waive any claims against the Released Parties for arranging or providing such assistance.

 

6. Acknowledgment of Third-Party Terms

I understand that I am subject to the terms, conditions, and liability waivers of the third-party Providers engaged by Evexia for retreat services. I agree to familiarize myself with these terms and comply with them fully.

 

7. Media Release

I grant permission for photographs, videos, or other media taken during retreat activities or experiences to be used by Evexia for promotional purposes. I understand that no compensation will be provided for such use. If I do not wish to grant this permission, I will notify Evexia in writing prior to the retreat.

 

8. Governing Law

This waiver shall be governed by and construed in accordance with the laws of Greece. Any disputes arising from this waiver or the Services shall be resolved in the courts of Greece.

 

9. Acknowledgment and Signature

By signing below, I confirm that:

  • I have read and fully understood this waiver;

  • I am signing voluntarily and without any inducement;

  • I accept and agree to all terms stated herein.
